PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. ORDERING OUR SERVICES BY SIGNING OUR CUSTOMER AGREEMENT FORM SHALL CONSTITUTE YOUR ACCEPTANCE OF OUR TERMS OF USE AND TO BE AWARE OF THE CONDITIONS OF PURCHASING.

1. Important Information about This Legal Contract
1.1. This Sale Agreement is a legal contract between the Customer and Eversman Technologies. The Customer accepts this Sale Agreement by purchasing our services by filling out and signing our customer agreement form, The terms and conditions of this Sale Agreement are subject to change without prior notice, except that the terms and conditions posted on the Site or customer agreement form at the time the Customer initially places or modifies an order will govern the order in question.

2. Basic Conditions of Purchasing at Eversman Technologies
2.1. You are informed that the web design is in English language only unless noted differently by the customer.
2.2. You will have 30 days after the site completion date to fulfill the quoted estimate when applicable.
2.3. If payment is not received within 30 days of the invoice, we have the right to remove the site from the domain until payment is received, or discontinue any future services.
2.4. We will not bill you for extra design hours required by us to change the website to fix any discovered problems or compatibilities that we missed in design.  We will not bill you for our mistakes.
2.5. You will not be billed for future debugging of your websites from our initial design. This is a free service from us to our customers.
2.6. You will not be billed if we decide to convert the site into a new program for future business.
2.7. You are not required to have any computer knowledge to receive our services. We can do the design, hosting, site management and updating for you if you desire. The only time required by the customer would be for meetings, and correspondence through email and phone for updates if they desire.
2.8 Rules on Estimates
2.81. We issue estimates as a proposal before beginning any work.
2.82 The client is required to pay 50% of the original estimate up front with a 100% customer money-back guarantee, before we start design.
2.83 The client is also required to sign the customer agreement form before we begin, which includes our privacy policy, terms and conditions, and contract description.
2.84 The client will be eligible for a full refund of this first 50% up to the completion of the site if not satisfied, which will be identified by them paying the other 50% at completion.
2.85 The client is not eligible for a refund after site completion.
2.86 The client will be contacted as soon as it is discovered the site would be more or less for approval. We cannot guarantee estimates due to unexpected tasks in development that may arise, including the customer requesting additional work to be done during development after the initial estimate was issued.  We will contact you when and if it will cost more before continuing.
2.87 When doing ongoing updates, we do bill hourly, and do not issue a bill until updates we perform reaches 4 hours @ $20/hour.
2.88 If the client makes changes on their site that requires us to fix them, they will be billed unless this content is part of the original contract. Clients that are wanting to update on their own are recommended to use Adobe Contribute version 3 or higher, FTP Commander, or Adobe Dreamweaver CS2 or higher to be able to assist them in future updates effectively.  
2.89 We also issue estimates for updates on request, and also may agree to commission from site sales by the customer in special circumstances.
2.9. If you decide to host through our recommended hosting company, we are not liable for any billing transactions between you and the company. You are responsible for making payments on time.
2.10. We do not provide support for you if you host on our recommended host unless we are managing the site for you after completion.
2.11 Deadline Policy
2.111 If the customer decides to add additional content to the site, such as webpages, graphics, forms, tables, etc.l, the deadline date is no longer valid unless it contributes to the original contract description. At this point, the customer will be contacted.
2.112 If we cannot complete what we stated in the contract by the deadline given the described information in 2.111, the client is eligible for a 20% discount off the estimate.

3. Delivery of Software or Hardware services purchased at Eversman Technologies
3.1. At the completion of your new site, we will upload a CD image file of all the files for you to have access to, including project files. They will be uploaded to your webspace on your domain, under a “backup CD” folder. The client will be able to download the ISO file and burn their own CDs or DVDs.


4. Format of Programming
4.1. Eversman Technologies uses only code like PHP, XHTML, JavaScript, CSS, etc to design web sites. We do not use Microsoft software or Microsoft-related features to do our websites such as SharePoint, FrontPage Server Extensions, or recommend Microsoft Domain Registration due to a lack of manageability we have with Microsoft-modified code. We recommend hosting only on Linux servers, and only design and updates websites for those types of servers.

5. Additional Charges
5.1. Ohio Sales Tax will be charged for only computer support with all billing from Eversman Technologies. Auglaize County Sales Tax will be charged since the work performed is in Auglaize County, but not applicable to web design. Exempt customers are required to fill out an exemption form.

6. Order Cancellation. Money back Policy.
6.1. By paying for the website when it is completed, you have agreed that you are satisfied with the product and are not eligible for refunds once payment is complete.

7. Terms of Service
7.1. Eversman Technologies reserves the right to refuse to sell product or provide service to anyone, at our own discretion.

8. Contacting Eversman Technologies
8.1. If you have any questions, email us and we will get back to you in a reasonable time to answer your questions.
8.2. Eversman Technologies reserves the right to inform its clients via e-mail about our special promotions and new services. In case the Customer wants to stop receiving email from us, he should reply to this email address with the Subject: Unsubscribe to be removed from further mailings.
